FINAL EXAMINATION
PROPERTY
Spring Semester 2006
TIME:    4   HOURS


DIRECTIONS: Be sure to put your correct exam card number on each page of this exam,  blue books, and scratch paper. Write legibly in ink.   This examination consists of 5 pages.   Count  to make sure none are missing.   Turn in this exam with any scratch paper and any blue book you use.

SPECIAL INSTRUCTIONS FOR THIS EXAMINATION: I consider this a 3 1/2 hour exam BUT you have
4 hours to complete it!   This  is a CLOSED BOOK examination.  This means you should have nothing with you except pens, eyeglasses, handkerchiefs, and the like.

You should have NO BOOKS OR PAPERS except this examination and blue books that you may also use as ‘scratch paper’ for preliminary outlines or drafts. 

This exam  consists of:  10 questions worth 10 points each; (note questions 9 and 10 are combined for a total of 20 points). 

For this exam the state of the law is:   The common law Rule Against Perpetuities is in effect.  The common law rules of construction are in effect.  Also in effect is a rule which says: “all conveyances and devises of real property are presumed to transfer all of the estate and interest of the grantor or testator in the property conveyed or devised in the absence of a clear intent to the contrary.”  The Constitution of the United States and amendments to it are in effect.   The following statute is also in effect: “An action to recover the title to or possession of real property shall be brought within twenty-one years after the cause thereof accrued, but if a person entitled to bring such action, at the time the cause thereof accrues, is within the age of minority, of unsound mind, or imprisoned, such person, after the expiration of twenty-one years from the time the cause of action accrues, may bring such action within ten years after such disability is removed.”  The Rule in Shelley’s Case, the Doctrine of Worthier Title, and the Rule of Destructibility of Contingent Remainders are not in effect.

If you are pre-registered to use ExamSoft: Be sure you have your AC/DC adaptor for your laptop computer, and two fully charged batteries.  Before the exam begins, you will be given a blank floppy disk by the proctor.  You are to insert the disk into your laptop, and double-click on the “softest” icon.  Your computer will be re-booted automatically.  “Click through” and read the information menus which are presented to you. Provide your exam number when prompted to do so.  Stop at the message that indicates you are to wait for the proctor to begin the exam.  The questions are on this hard copy only, not on the computer.

NOTICE:  If you are aware of any possible violations which occurred during the course of this examination or other written assignment, it is your duty to contact Erin Keyes, the Assistant Dean of Students, or Carl Warren, the Honor Code Investigator.  Failure to do so is a violation of this Honor Code.  Among its other provisions, the Honor Code prohibits you from writing or retaining your examination answer after the exam has ended, or writing your examination in any place other than the locations designated for the exam.
